The LCS's home page (here) carries a large "advert" for "choosing and using a solicitor". What you can't tell from the Law Society is how bad a solicitor is in terms of how many complaints the solicitor or firm has received. We have a situation where the so-called "independent regulator" is promoting firms it knows to be bad along with all the others. They do not tell us which is which.
Of course, it does not matter how good the "new regulators" are... if you are going to choose and use a solicitor it is far better to avoid problems in the first place. There is no guaranteed method for avoiding the bad... but one very good indicator has to be past performance... the following tips may help...
Most of us only use a solicitor occasionally, but when things do go wrong, they can go very wrong indeed. It is well worth investing some time in staying out of trouble.
Choosing and Using a solicitor...
Ask around, friends, family, anyone you trust who doesn't have a vested interest in recommending anyone.
When asking... always ask for FACTS. Lots of folks will say "so and so was ok, good" etc. but this doesn't tell you much. Try and find out what they charged? How long it took? Did it cost more or less than the estimate? What type of work? (expertise in one field does not necessarily carry over to another, and not all partners in a firm are equal).
Create a short list of firms you think may be ok.
Visit each one on the list on the www and see what you think. Find out the names of ALL the partners.
Dig for dirt. Do an internet search on the firm and on each and every partner by name - reject any that have "bad-press" - you really don't need to take the risk that they will do to you what they did to someone else.
When you have narrowed it down... ask for a free consultation and go and interview them. If you like them get a (free) written estimate. You may also find some free legal advice that way.
Don't be afraid to change your mind... if necessary ... start again... this is probably a BIG decision and the wrong one can leave you severely out of pocket.

Years ago, when I was studying Quality Assurance, I was told that for every customer that complains there is another ten who don't. Past complaints are a very good indicator of problems. If our own survey takes off it should prove a very good source for information - these are folks who have complained again and again - serious complaints...

So... if one in ten complain to the law firm then it's probably more like 1 in 100 that go as far as complaining to the Law Society. For complaints to reach the Legal Services Ombudsman it requires persistent genes and a serious complaint... Our results will tell you the names of the Firms to be wary of and the year of the complaint... well worth checking. As a rough guide, the more times a firm is listed the worse you may (reasonably) expect them to be.
